1. General provisions

1.1. UAB Energy Green (hereinafter referred to as the Company), company code 302497397, registered address Grendavės str. 17, Vilnius, LT-21540, Lietuva , privacy and cookie policy (hereinafter referred to as the Policy) defines how the Company collects, uses, and stores data about the website www.energygreen.lt, and the store https:// b2b.energygreen.lt (hereinafter collectively referred to as the "Website") (hereinafter referred to as "Subjects").

By using the Company's Website, as well as by ordering goods and providing the Company with your personal data, you agree to the provisions of this Privacy Policy (except for data processing activities that require your separate consent). Subjects are deemed to have read the Privacy Policy when they register or place an order on the Website and tick the box below the text of this policy. The Privacy Policy can be reviewed at any time in the "Privacy Policy" section of the Website.

1.3. When processing your personal data, we comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the "Regulation"), the Law on Legal Protection of Personal Data of the Republic of Lithuania (hereinafter referred to as the "ADTAĮ"), the Law on Electronic Communications of the Republic of Lithuania (hereinafter referred to as the "LEA") and other directly applicable legal acts regulating the protection of personal data, as well as the instructions of data protection supervisory authorities (in Lithuania – the State Data Protection Inspectorate).

2. Data collected by the company

2.1. The Company may collect and process the following data of Subjects:
 

  • Data provided by Subjects when filling out forms on the Website. This data includes the Subject's first name, last name, email address, telephone number, delivery address, name of the product being ordered, payment details, and other information provided when filling out the registration form, registering in the online store, placing an order, sending messages in the system, requesting additional services, or reporting malfunctions in the online store. The Company may also offer to fill in certain forms so that the Subject can participate in competitions, promotions, and games organized by the Company;

  • Data about the Subject's browsing history in the online store, history of purchased goods and services, and related data;

  • Subjects' first and last names, email addresses, and phone numbers, when this data is processed for direct marketing purposes and the Subject has given their consent for this purpose;

  • Subjects' IP addresses;

2.2. The Entities are responsible for the accuracy and authenticity of the data submitted to the Company.

3. Cookies and the purposes of their use
 

Cookies are small text files that the Company sends to your computer or other device when you visit the Website. Cookies are used to:

  • Improve your browsing experience on the Website;

  • Recognize you when you return to the Website;

  • Collect statistical information about the use of the Website;

  • Show you relevant advertisements.

  • You can disable cookies at any time in your browser settings. However, please note that if you disable cookies, some features of the Website may not function properly.

4. Storage of subject data
 

4.1. The Company stores your personal data for no longer than is necessary to achieve the purposes of data processing, except in cases where the law provides for a longer data storage period.
 

4.2. The data collected by the Company from Data Subjects may be processed by the Company or its suppliers' personnel. In cases where the data of Subjects is processed by the Company's suppliers (i.e., data processors), the Company has entered into agreements with them that properly regulate the obligations of data processors. Data processors have the right to process personal data only in accordance with the Company's instructions and only to the extent necessary to properly perform the obligations set out in the contract. The transfer of Subjects' data to suppliers (data processors) may be related to the fulfillment of Subjects' orders and the processing of Subjects' payment data. By providing their personal data, Subjects consent to this transfer and processing. The Company takes all reasonable measures to ensure that Subjects' data is processed securely and in accordance with the provisions of this Policy.
 

4.3. Data provided by Subjects is stored on the Company's servers or in paper copies of documents. In cases where Subjects are provided with passwords (or where Subjects choose them themselves) that enable Subjects to use certain functions of the online store, Subjects are responsible for the confidentiality of their passwords and for not disclosing them to third parties.

4.4. If the Company has doubts about the accuracy of the data provided by the Subjects, the Company has the right to suspend the processing of this Subject's data, check and verify this data.

5. Consent of the subject to data processing for direct marketing purposes
 

The Company processes your personal data for direct marketing purposes only if you have given explicit consent by ticking the relevant box. You may withdraw your consent at any time by:

  • Unchecking the relevant box in your user profile or registration form (if available),

  • Clicking the "unsubscribe" link included in any direct marketing communication, or

  • Contacting the Company via email at info@energygreen.lt

.

Your withdrawal of consent will not affect the lawfulness of any data processing carried out before the withdrawal.

6. Purposes of processing subjects' data

6.1. The Company processes the personal data of Subjects for the following purposes:

  • To provide services to Subjects (customers);

  • To conclude and execute purchase and sale agreements with Subjects (customers);

  • To collect debts;

  • To ensure that the content of the online store is presented in the most effective and appropriate way for Subjects;

  • For the purposes of service development, statistical data analysis, and targeted marketing;

  • To provide Subjects with information about the goods or services that Subjects desire;

  • For the purposes of responding to and administering Subjects' requests for information;

  • To provide advertising information when Subjects have given their consent to the processing of personal data for direct marketing purposes;

  • To inform Subjects about changes to the services provided by the Company;

  • For the purpose of customer service quality.

 

7. Disclosure of data
 

7.1. Personal data is only transferred to trusted third parties with whom we have concluded agreements, and only to the extent necessary to provide the service. In order to provide you with the appropriate services, we transfer your personal data to the following partners:

  • Courier companies that deliver goods to you at the addresses you specify;
     

7.2. We may also transfer your Personal Data:

  • Law enforcement authorities in accordance with the procedure established by the laws of the Republic of Lithuania;

  • State institutions and courts when such an obligation is provided for by applicable laws.

 

8. Rights of entities
 

8.1. Entities have the following rights:

  • Be informed about the processing of their data;

  • Upon submitting a request to the Company, receive information about the sources and types of personal data collected, the purposes for which it is processed, and the recipients to whom it has been provided and has been provided to over the past 1 year. The information shall be provided to the Subjects at their specified e-mail addresses no later than within 30 days from the date of the Subjects' request to provide such data. The Company shall provide such data to the Subject free of charge once per calendar year;

  • Upon submission of a request, to demand the correction of incorrect, incomplete, inaccurate Subject data and/or the suspension of the processing of such personal data, except for storage, if the Subject determines that their personal data is incorrect, incomplete or inaccurate, or processed unlawfully and unfairly. The Company shall immediately inform the Subject of the correction, destruction, or suspension of the processing of personal data performed or not performed at his request.

  • Upon submitting a request, the Subject has the right to receive personal data related to him/her, which he/she has provided to the Company, in a structured, commonly used, and machine-readable format so that such data can be transferred to another data controller (right to data portability);

  • To object to the provision of data for direct marketing purposes as set out in section 5.2 of the Policy;

  • Upon submission of a request, the Subject has the right to request that the Company delete personal data related to him/her when the person does not agree or revokes his/her consent to data processing (the right to be forgotten), except in cases where the Company cannot delete the Subject's data due to its necessity for the performance of the contract or due to the mandatory enforcement of legislation;

  • The Subject has the right to receive information about violations of the security of his data. The Company undertakes to send a notification to the Subject by email (if known to the Company) within 72 hours of becoming aware that the Subject's data has been compromised (e.g., the Company's server has been hacked, etc.).

  • If you disagree with the Company's actions or inaction, you have the right to file a complaint with the State Data Protection Inspectorate.

  • All inquiries and requests related to Subject Data must be sent to the Company's email address info@energygreen.lt. The Company representative receiving the request has the right to request the submission of an identity document or a copy thereof certified in accordance with the procedure established by law.

  • The Company shall respond to requests and inquiries from Entities within 30 days of receipt.

 

9. Final provisions

9.1. The policy shall enter into force on February 10, 2022.​

9.2. The Company may change this privacy policy at any time. Changes shall take effect from the date of their publication on the Website.
